General terms and conditions
of the "LAiKA" module
by Athereon GRC GmbH
Athereon GRC GmbH—hereinafter referred to as “Athereon”—provides the “LAiKA” module—hereinafter referred to as the “Software”—in addition to Athereon’s General Terms and Conditions (available at: www.athereon.de/en/gtc) on the basis of these terms and conditions:
1 Definitions
1.1 "Prompt" refers to all data, content, and other information provided by the contracting party to the software as input parameters.
1.2 "Output" refers to any result or content generated by the software in response to a prompt.
2 Prohibition on input
2.1 The contracting party is obligated to use only those prompts whose use complies with applicable law.
2.2 The contracting party is prohibited from using prompts that violate official regulations or infringe upon the rights of third parties, in particular intellectual property rights.
2.3 It is the responsibility of the contracting party to verify the legality of the use of a prompt.
3 Right to use the input
The contracting party grants Athereon a non-exclusive, transferable license, limited to the term of the agreement, to use the prompt, including, in particular, the right to reproduce, modify, and incorporate it into the Software.
4 Legality of the output
4.1 Athereon is entitled to verify the legality of any output generated by the contractual partner.
4.2 Athereon is entitled to immediately delete any invalid output before it is displayed to the contractual partner in the software.
4.3 It is the responsibility of the contracting party to verify the legality of any further use of an output, in particular whether such use infringes upon the rights of third parties.
5 Accuracy of the output
5.1 The output generated by LAiKA is based on a language model (LLM). Language models do not operate deterministically, but probabilistically. The contracting party is made aware that a prompt may generate different output each time it is used identically. The contracting party is made aware that the output may be untrue.
5.2 Athereon is not responsible for the factual accuracy of the output. It is the responsibility of the contracting party to verify the quality of the output’s content. Athereon recommends that the output always be subject to human review.
